After the Supreme Court overturned Roe v. Wade in 2022 and ended the constitutional right to abortion, 10 states posed ballot questions in this year’s general election asking voters about amending state reproductive rights. Those states are Arizona, Colorado, Florida, Maryland, Missouri, Montana, Nebraska, Nevada, New York, and South Dakota. Here are the results.
Arizona
A ballot question in Arizona successfully passed Proposition 139, which added an amendment guaranteeing abortion access until fetal viability to the state constitution, the Associated Press calls.
Colorado
Colorado successfully passed Amendment 79, which enshrines the right to abortion in the state constitution and prevents state and local governments from limiting access to it, according to the Associated Press. The amendment also rescinds the current state ban on funding for abortions and permits government health insurance and Medicaid to cover the costs. It required a 55% majority to pass.
As of 6:14 p.m., 61.4% of voters selected “yes,” according to the New York Times.
Florida
Florida voters failed to pass Amendment 4, which would expand legal state abortion before viability or when necessary for a patient’s health. State law currently prevents abortion after six weeks.
With a 60% majority required to pass, the approval rate fell short. With more than 95% of the votes counted, only 57.1% of voters said “yes,” according to the New York Times.
Maryland
Maryland successfully passed Question 1 on the state ballot, which asked voters if the right to abortion should be dictated in the state constitution. While Maryland law currently protects the right to abortion, this new amendment will make that law more difficult to overturn.
Missouri
Voters approved Missouri Amendment 3, which will enshrine abortion rights in the state constitution. The current state law is one of the most restrictive: prohibiting all abortions unless there is a medical emergency.
Montana
Montana successfully passed Amendment 128 on the ballot, which now includes the right to abortion in the state constitution. While Montana law currently allows abortion, the new amendment will prohibit the state government from limiting access.
Nebraska
Nebraska had two abortion-related initiatives on the ballot: one amending the state constitution to prohibit abortion past the first trimester of pregnancy, Initiative 434, and another amending the state constitution to enshrine the right to procedure until viability, Initiative 439. Initiative 434 passed, while Initiative 439 did not. Initiative 434 will still allow abortions past the first trimester in cases of medical emergency or from pregnancies caused by sexual assault or incest.
Nevada
Nevada approved Question 6 on the ballot, which asked voters if the state constitution should be amended to include the fundamental right to abortion until viability or when needed to protect the health of a pregnant person. However, voters must also approve the motion during the 2026 general election before the amendment is applied.
New York
New York voters approved Proposition 1 on the state ballot, which asked voters if the language of the state constitution should be amended to protect the civil rights of those seeking and who have had abortions.
South Dakota
South Dakota rejected Amendment G, which asked voters if an amendment regarding abortion rights should be added to the state constitution. The amendment allowed for no restrictions within the first trimester, permitted limitations in the second trimester, and prohibited abortions during the third trimester, except in the case of a medical emergency. Current state law prohibits all abortions unless they are necessary to save the life of the pregnant mother.
